If you haven’t heard, Section 6055 and 6056 is an Affordable Care Act (ACA) compliance provision.  All companies with 50 or more full-time employees must complete this ACA reporting requirement. No exception!
  
Section 6055 and 6056 requires applicable employers to complete Forms 1094-C (transmittal furnished to the IRS) and 1095-C (statements furnished to each employee) on an annual basis, similar to a Form W-2 reporting. The purpose of these forms is for the IRS to administer and enforce the Employer Mandate and the Individual Mandate. Mandate, of course, referring to penalties. 
 
The penalty for non-compliance is very costly: $250 for each employee statement with a penalty maximum of $3,000,000. For a company with 100 employees the penalty will be $25,000.
